Abstract

the article deals with the characteristic and relationship the unspoken investigation (investigative) and operational search actions. It defines the principles of the criminal proceedings, which include the content and form of the unspoken investigation (investigative) and operational search actions. Is given the analysis the procedures and the process provisions of securing factual data as evidence in such way that the due process has been applied to each participant in criminal proceedings. Considered new theoretical approaches to the solution of arising practical problems, and makes recommendations to improve the mechanism of legal regulation, and increase the efficiency of criminal law on criminality.
