PARALLEL PROCEEDINGS IN A NATIONAL COURT AND INTERNATIONAL COMMERCIAL ARBITRATION
Abstract
the article analyzes the procedure of initiating parallel proceedings in the court and in the international commercial arbitration as one of the procedural tactics of the parties to achieve their goal. The attention is focused on the fact that the party that sees the potential weakness of its position in arbitration proceedings, appeals to the state court to resolve the dispute by the state judicial system. The conclusion is made about the ineffectiveness of such tactics of the parties, taking into account the existing international arbitration legislation and the competence of the arbitral tribunal.
