Genesis of legal foundations for the formation of a public-service state model in Ukraine.
Abstract
The article analyzes the genesis of the legal foundations for the formation of a public service state model in Ukraine. The evolution of national legislation is examined, from the earliest regulatory acts in the fields of informatization and access to information to the contemporary comprehensive legal regulation of electronic public services. It is substantiated that the development of the public service state model has a clearly defined stage-based character
(the infrastructural–informational stage, the institutional–procedural stage, and the stage of digital transformation) and is directly dependent on the advancement of information and communication technologies as well as on changes in the governance paradigm of interaction between the state and the citizen. It is established that, at the initial stage, the regulatory foundations of governmental openness were laid and the category of “information service” was legitimized, which contributed to the transformation of the state from a subject of authoritative control into a provider of basic information services. The role of legislation on electronic documents and electronic signatures in the formation of an “infrastructure of legal trust,” which ensured the legal possibility of remote interaction between the state and the individual, is characterized. The institutionalization of administrative services as the central form of implementing the service function of the state is examined. The main directions of sectoral adaptation of legislation to the service model in the registration, licensing, and social spheres are systematized. It is proven that the integration of legal norms into digital algorithms has made it possible to automate administrative procedures, minimize the subjectivity of officials, and reduce corruption risks. It is substantiated that the author’s periodization of the development of the legal foundations for the formation of the public service state model in Ukraine reflects the logic of transition from information provision to the proactive delivery of public services within a unified digital ecosystem. It is shown that the anthropocentric approach has become the conceptual core of the modern service model, in which the individual is regarded as the subject and customer of public services, while the state acts as a service provider responsible for their convenience, accessibility, and quality. The prospects for further research related to the regulatory framework for the use of artificial intelligence in public administration and to the strengthening of personal data protection are identified.
