State regulation of the activities of banking institutions of Ukraine in the conditions of digitization
Abstract
The article examines the features of state regulation of banking institutions in Ukraine in the context of digitalization of the financial sector and the development of the information society. An analysis of scientific literature shows that the banking sector. Its effectiveness largely depends on the level of institutional development, the quality of corporate governance and the ability to adapt to digital transformations. It is proven that the banking sector is a system-forming element of the financial system, an important factor in sustainable development and plays a decisive role in ensuring economic growth, financial stability, effective redistribution of financial resources, and is also an important component of national security. It is substantiated that the digital transformation of banking significantly changes the traditional mechanisms of banking supervision, prudential regulation and interaction between state regulators and financial institutions. The regulatory and legal support for state regulation of the banking system of Ukraine is analyzed, taking into account the implementation of digital banking services, financial technologies (fintech), remote identification of customers, automated payment systems and digital service channels. The key role of the National Bank of Ukraine in the formation of an adaptive regulatory model aimed at ensuring financial stability, cybersecurity and protecting the rights of consumers of banking services is identified. The international experience of state regulation of banking activities in the context of digitalization and the possibility of its implementation in Ukraine are analyzed. According to the results of the study, key problems of state regulation of banking activities in the context of digital transformation are identified, in particular, the fragmentation of the legal field, the growth of cyber risks and the need to update banking supervision tools. Ways of transforming state regulation of banking institutions are proposed, taking into account European integration processes and the challenges of the digital economy. The main directions of development of state regulation of banking institutions in Ukraine in the context of digitalization are substantiated, namely: modernization of the regulatory framework, implementation of risk-oriented supervision, integration of digital technologies into risk management systems, ensuring cybersecurity and financial stability, as well as stimulating innovations in the financial sector while simultaneously protecting customer rights. The research methodology is based on a systemic and comprehensive approach, analysis of legislation, comparative analysis of international practices, and generalization of modern scientific research
