Abstract

the article is devoted to problems of historiosophy of law. It is shown main features of understanding of historic and legal process by representatives of German Historical School of Law. The particular attention is devoted to scientific position of one of tower figures on this School German scientist F. C. von Savigny. According his position the creator of law is the people. Law cannot be construct artificially. Law as language are characterized to organic connection with existence and character of people. Savigny was the first scientist who proved that any positive law was formed and grown on the rest of customary law.
