Termination of the professional liability insurance contract
Abstract
This article deals with the problems of termination of the professional liability insurance contract. The author pays attention to the fact that the causes that lead to the termination of the insurance contract are the reasons that do not depend on the will of the parties; reasons that do not depend on the will of one of the parties; reasons which depend on the will of the both parties. The author specifies that the grounds for termination of the insurance contract are provided by the Insurance Act of Ukraine, however, in this article, the author focuses on such grounds for termination of the professional liability insurance contract as a unilateral refusal to the contract and its termination.
Professional liability insurance contract has its own peculiarities. The author of this article discusses the grounds of a unilateral refusal to the professional liability insurance contract for the insurer and the insured and legal consequences of that contract refusal for each party. In a comparative perspective the author analyzes the provisions of Article 958 of the Russian Federation Civil Code on the termination of an insurance contract before the term which he was concluded for. The author notes that cessation of the professional activity in the prescribed manner is an appropriate ground for the insured to withdraw from the professional liability insurance contract
The article focuses on such termination grounds of the professional liability insurance contract as the termination of the contract by the agreement of the parties; in connection with the breach of the contract; in the event of the change in circumstances that were significant for the parties at the conclusion of the contract.
