Abstract

the article defines methodological approaches for making a court decision in a civil case. The requirements of the new civil procedural law are taken into account before the court decision is made. The attention is focused on the principle of the rule of law as the basis of civil procedural law. There is shown a connection between making a court decision in a civil case and the rule of law. It is proposed to abandon the formalism of the civil process when it goes against human rights. The attention is paid to the application of system-structural and formal-logical methods while making a court decision in a civil case.
