Issues of interaction of subjects of public management of the territorial community land resources

Abstract

The article proves the necessity to improve the quality of interaction between the subjects of public land management as one of the indicators of success of management and community development. In the framework of this study, the subjects of management include: community council and its executive bodies, district state administrations, district councils, territorial bodies of the State Geocadastre, community (as an aggregate of local people). Their functions and structure, regulatory framework governing the relevant powers have been analyzed. On the basis of the author’s visualized model of interaction of state authorities, local government bodies, community residents on the issues of public management of land the interrelations have been singled out (those which are actually formed and those that are only nominally established by the legislation). Weaknesses and gaps in the regulation of interaction mechanisms have been highlighted, they include: unregulated status of district state administrations and district councils in the context of land powers (in particular, inconsistency of structure functions); lack of motivation for cooperation of management entities; the need to standardize the mechanism of management of state lands located in the community; the need to develop and consolidate effective mechanisms for involving the public sector in decision-making; development of an effective control system in the field of land relations, taking into consideration the significant expansion of the powers of local governments and a new stage in the formation of the land market.

The article suggests a list of measures to resolve disputes, to establish cooperation between public administration entities, and to complete land decentralization. Such measures include: the introduction of a district prefecture, the land department of which will perform control and supervision powers, coordinate horizontal interaction, in particular in the field of management of community common land resources; as well as, legislative consolidation of mechanisms for community participation in decision-making, normative assurance of holding a local referendum as a form of direct democracy. It has been determined that the proposed measures will help increase the efficiency of public management of land, which is the main resource of the territorial community, reduce corruption risks, create conditions for the development of the land market.
