СУТНІСТЬ І ЗМІСТ МІЖНАРОДНОГО ГУМАНІТАРНОГО ПРАВА В СУЧАСНОМУ МІЖНАРОДНОМУ ПРАВІ

Abstract

The article deals with the substance and contents of humanitarian law, the formation process of division of laws and customs of war referred to as «jus in bello» from the right to the war referred to as «jus ad bellum». Besides, the theoretical interpretation of substance and contents of humanitarian law in general and narrow sense is analyzed. Simultaneously, the writer makes an attempt to determine the correlation between human rights and humanitarian law.
