Legal principles for making public management decisions regarding the development of human resource potential of enterprises in the context of digitalization

Abstract

This paper analyzes the legal principles for making public management decisions concerning the development of the human resource potential of enterprises in the context of digitalization. The importance of management decisions in public administration is emphasized by a set of complex processes that require managers to analyze information, evaluate alternatives, and consider risks. The author provides definitions for the concepts of "management decision-making in public administration" and "management decision". Key legislative initiatives that promote the improvement of human resource potential through the integration of new technologies into educational programs and professional development are examined. Additionally, the research ensures a legal basis for the use of electronic documents and electronic document management in labor relations. In particular, emphasis is placed on the Constitution of Ukraine, the Labor Code of Ukraine, and laws of Ukraine on "Personal Data Protection", "Electronic Identification and Electronic Trust Services", "Electronic Documents and Electronic Document Management", "Electronic Commerce", and "Organization of Labor Relations in Conditions of Martial Law". The advantages and disadvantages of legal regulation for the development of human resource potential in enterprises under conditions of digitalization are identified. The research concludes that effective development of human resource potential in enterprises within the modern business environment is possible only with a proper legislative framework and readiness to implement new technologies.
