Удосконалення публічно-правового регулювання відносин у сфері соціального захисту в контексті європейської інтеграції України
Анотація
У контексті європейської інтеграції України, розвитку вітчизняної моделі соціальної держави, а також викликів, спричинених збройною агресією РФ, актуалізується здійснення досліджень стосовно вдосконалення публічно-правового регулювання у сфері соціального захисту. Метою дослідження є теоретичне обґрунтування напрямів удосконалення публічно-правового регулювання відносин у сфері соціального захисту в контексті європейської інтеграції України. Дослідження ґрунтується на філософсько-світоглядних, загальнонаукових та спеціально-наукових методах дослідження (діалектичний, системний, аналітичний, формально-логічний, функціональний, прогностичний тощо). На основі аналізу підходів до сутності публічно-правового регулювання відносин у сфері соціального захисту запропоновано його авторське визначення, з’ясовано специфіку такого регулювання та його властивості. Акцентовано увагу на необхідності переходу від моделі екстреної грошової допомоги до людиноцентричного підходу. Детально проаналізовано фундаментальні принципи, що визначають характер і межі публічно-правового регулювання відносин у сфері соціального захисту (законності, забезпечення публічного інтересу в соціальній сфері, соціальної відповідальності держави). Сформульовано пропозиції щодо напрямів покращення публічно-правового регулювання відносин у сфері соціального захисту відповідно до сформульованих в ЄС ключових принципів і прав для підтримки справедливості та добробуту у сфері соціального захисту, а також визначених цілей сталого розвитку України на період до 2030 року. Перспективи подальших досліджень стосуються розробки концептуальних засад і стратегій розвитку систем соціальної підтримки, ефективних механізмів залучення громадян до формування, реалізації та оцінки соціальної політики, а також подальшого покращення публічно-правового регулювання соціального захисту з урахуванням рівня надання соціальних послуг.
