SAFETY IN PIPELINE TRANSPORT: PUBLIC ADMINISTRATION

Abstract

Pipeline transportation is the most economical type of transportation of oil, petroleum products and gas from the production and production sites to the areas of their use and processing. Trunk oil pipelines and gas pipelines transport these products over long distances with the shortest line with the least losses. Its development is conditioned by the development in Ukraine of the oil, refining and gas industries.

Ensuring an adequate level of pipeline safety management is one of the main tasks of the modern state. Recognizing the importance of pipeline transport for Ukraine, it is necessary to pay greater attention to the safety of oil and gas pipelines, which at present remains insufficient.

Trunk oil and gas pipelines fall into the category of energy-intensive facilities, the failures of which are usually associated with significant material and environmental damage.

The factors that cause accidents can be divided into those that contribute at the design stage (incorrect choice of material, manufacturing technology, neglecting operating conditions), manufacturing (violation of technology, use of materials of poor quality, insufficient attention to control measures) and operation (corrosion, external mechanical actions, aging of the metal), unauthorized insertions, the influence of external forces and the environment. In Ukraine, one of the causes of accidents is the subjective factor associated with negligent treatment of the pipeline or breach of operating requirements.

The main law governing pipeline transport is the Law of Ukraine “On pipeline transport” (as amended).

State administration in the field of pipeline transport is carried out by the Ministry of Fuel and Energy of Ukraine, as well as local state executive and local self-government bodies within their competence pipeline transport does not belong to the Ministry of Infrastructure of Ukraine.

Public administration in the field of pipeline transport carried out by central and local bodies of the state executive authorities, representative bodies and local authorities in within their competence in accordance with the current legislation of Ukraine.

For a special period direct management of enterprises pipeline transport and control over their activities are provided by the bodies of the Ministry of Defense of Ukraine.

State control in the field of pipeline transport is carried out by the respective ministries and agencies, state oversight and control bodies and other specially authorized state bodies, as well as representative bodies and local self-government bodies in accordance with the legislation of Ukraine.

Thus, in view of the above, it is possible to draw the following conclusions:

1. Maintaining an adequate level of transport security in Ukraine is one of the main tasks of the modern state, its status in comparison with the developed countries of the world is unsatisfactory, so it is not receiving enough attention so far.

2. Public administration in the field of pipeline transport safety shall be carried out by the Ministry of Fuel and Energy of Ukraine, as well as local state executive authorities and local self-government bodies within their competence;

3. Pipeline transportation provides its security for which there are appropriate guidance documents, forces and means.

4. Simultaneously with the above, there is a lack of overall management of Ukraine’s transport safety and of the interaction of pipeline transport with other modes of transport in the field of transport safety, which would be documented.
